1. General information 

Based on Article 13 of the Swiss Federal Constitution and the data protection regulations of the Swiss Confederation (Data Protection Act, DPA), every person is entitled to protection of his or her privacy and protection against misuse of his or her personal data. JobDone AG takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. 

In cooperation with our hosting providers, we make every effort to protect the databases as well as possible against unauthorized access, loss, misuse, or forgery. 

We would like to point out that data transmission over the Internet (e.g., communication by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible. 

This privacy policy applies to the use of all software services provided by JobDone AG. In particular 

By using the JobDone software services you agree to the collection, processing and use of data as described below. The JobDone software services can generally be visited without registration. Data such as pages accessed or the name of the file accessed, date and time will be stored on the server for statistical purposes without this data being directly related to your person. Personal data, in particular name, address or e-mail address are collected on a voluntary basis as far as possible. The data will not be passed on to third parties without your consent. 

2. Processing of personal data 

Personal data is all information that relates to an identified or identifiable person. A data subject is a person about whom personal data is processed. Processing includes any handling of personal data, irrespective of the means and procedures applied, in particular the retention, disclosure, acquisition, deletion, storage, modification, destruction and use of personal data. 

We process personal data in accordance with Swiss data protection law. In other respects, we process personal data – insofar and to the extent that the EU DSGVO is applicable – in accordance with the following legal principles in connection with Art. 6 Para. 1 DSGVO: 

lit. a) Processing of personal data with the consent of the person concerned. 

lit. b) Processing of personal data for the purpose of fulfilling a contract with the data subject and for the implementation of appropriate pre-contractual measures. 

lit. c) Processing of personal data for the fulfilment of a legal obligation to which we are subject under any applicable law of the EU or under the applicable law of any country in which the DSGVO is applicable in whole or in part. 

lit. d) Processing of personal data to protect the vital interests of the data subject or of another natural person. 

lit. f) Processing of personal data for the purpose of safeguarding the legitimate interests of us or of third parties, except where such interests are overridden by fundamental freedoms and rights or by the interests of the data subject. 

Legitimate interests include in particular our business interest in being able to provide our software services, information security, the enforcement of our own legal claims and compliance with Swiss law. 

We process personal data for the duration necessary for the respective purpose or purposes. In the event of longer-term storage obligations due to legal and other obligations to which we are subject, we will restrict the processing accordingly. 

3. Cookies 

The JobDone software services use cookies. These are small text files that allow specific information relating to the user to be stored on the user’s terminal equipment while they are using the software services. Cookies make it possible, in particular, to determine the frequency of use and the number of users of the pages, to analyse the behaviour of page use, but also to make our services more customer friendly. Cookies remain stored at the end of a browser session and can be called up again when the site is visited again. If you do not wish this to happen, you should set your Internet browser settings to refuse to accept cookies. 

A general objection to the use of cookies used for online marketing purposes can be declared for many of the services, especially in the case of tracking, via the EU site http://www.youronlinechoices.com/ or the US site http://www.aboutads.info/choices/. Furthermore, the storage of cookies can be achieved by deactivating them in the browser settings. Please note that in this case not all functions of this online offer can be used. 

4. SSL-/TLS-Encryption 

The JobDone software services use SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as the requests you send to us as the software service provider. You can recognise an encrypted connection, for example, in your browser by the fact that the address line changes from “http://” to “https://” and by the lock symbol in your browser line. 

If the SSL or TLS encryption is activated, the data that you transmit to us cannot be read by third parties. 

5. Server-Log-Files 

The provider of our website and JobDone automatically collect and store information in so-called server log files, which your browser automatically sends to us. These are: 

These data cannot be assigned to specific persons. A consolidation of this data with other data sources is not carried out. We reserve the right to check this data subsequently if we become aware of concrete indications of illegal use. 

6. Third party services 

The JobDone software services use Google Maps to embed maps, Google Invisible reCAPTCHA to protect against bots and spam, and YouTube to embed videos. 

These services of the U.S. Google LLC use cookies among other things and as a result data is transferred to Google in the U.S. We assume that Google does not perform any personal tracking in this context solely using our website. 

Google is committed to ensuring an appropriate level of data protection in accordance with the American-European and the American-Swiss Privacy Shield.

7. Contact form 

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We will not pass on this data without your consent. 

8. Newsletter data 

If you would like to receive the newsletter offered on the JobDone website, we need an email address from you as well as information that allows us to verify that you are the owner of the email address provided and agree to receive the newsletter. Further data will not be collected. We use these data exclusively for sending the requested information and do not pass them on to third parties. 

You can revoke your consent to the storage of the data, the email address, and its use for sending the newsletter at any time, for example by clicking on the “unsubscribe” link in the newsletter. 

9. Right to information, deletion, blocking 

You have the right to receive information free of charge at any time about your stored personal data, its origin and recipients and the purpose of data processing, as well as the right to correct, block or delete this data. You can contact us at any time at the address provided for this purpose and for further questions about personal data. 

10. Objection for advertising mails 

We hereby object to the use of contact data published within the scope of the imprint obligation to send advertising and information material not expressly requested. JobDone AG expressly reserves the right to take legal action if unsolicited advertising information is sent, for example by spam emails. 

11. Chargeable services 

In order to provide chargeable, we ask for additional data, such as payment details, in order to be able to carry out your order. We store this data in our systems until the legal storage periods have expired. 

12. Google Maps 

The JobDone software services use Google Maps API to visually display geographic information. When using Google Maps, Google also collects, processes and uses data about the use of the map functions by visitors. You can find more information about data processing by Google in the Google Privacy Policy. There you can also change your personal data protection settings in the data protection centre.

13. Google AdWords 

The JobDone software services use Google conversion tracking. If you came to our software services through an ad placed by Google, Google AdWords will place a cookie on your computer. The conversion tracking cookie is set when a user clicks on an ad placed by Google. These cookies expire after 30 days and are not personally identifiable. If the user visits certain pages on our site and the cookie haven’t expired, we and Google can tell that the user clicked the ad and was redirected to that page. Each Google AdWords customer receives a different cookie. As a result, cookies cannot be tracked across the websites of AdWords customers. The information collected through the conversion cookie is used to compile conversion statistics for advertisers who have opted into conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users. 

If you do not wish to participate in tracking, you can refuse to accept cookies by changing your browser settings to disable automatic placement of cookies or to set your browser to block cookies from the domain “googleleadservices.com”. 

Please note that you may not delete the opt-out cookies unless you wish to record measurement data. If you have deleted all your cookies in your browser, you have to set the respective opt-out cookie again. 

14. Google reCAPTCHA 

The JobDone software services use the reCAPTCHA service from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). The purpose of the query is to distinguish whether the input is human or automated, machine processing. The query includes the sending of the IP address and any other data required by Google for the service reCAPTCHA to Google. For this purpose, your input will be transmitted to Google and used there. Your IP address will, however, be shortened by Google within member states of the European Union or in other signatory states of the Agreement on the European Economic Area before it is used. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of JobDone, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser in the context of reCAPTCHA is not combined with other data from Google. Your data may also be transferred to the USA. For data transmissions to the USA, an adequacy decision of the European Commission, the “Privacy Shield”, is in place. Google participates in the “Privacy Shield” and has submitted to the requirements. By clicking on the query, you consent to the processing of your data. The processing is carried out based on Art. 6 (1) lit. a DSGVO with your consent. You may revoke your consent at any time via Google, without affecting the legality of the processing carried out based on the consent until revocation.

15. Google Analytics 

The JobDone software services use Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. To disable Google Analytics, Google provides a browser plug-in at https://tools.google.com/dlpage/gaoptout?hl=en Google Analytics uses cookies. These are small text files which make it possible to store specific information relating to the user on the user’s terminal device. These enable Google to analyse the use of our website offer. The information collected by the cookie about the use of our website (including your IP address) is usually transferred to a Google server in the USA and stored there. We would like to point out that on this website Google Analytics has been extended by the code “gat._anonymizeIp();” in order to ensure an anonymized collection of IP addresses (so-called IP-Masking). If anonymisation is active, Google will shorten IP addresses within member states of the European Union or in other states that are party to the Agreement on the European Economic Area, which means that no conclusions can be drawn about your identity. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. 16. Google AdSens 

The JobDone software services use Google AdSense, an ad serving service from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google AdSense uses so called “cookies”, text files that are stored on your computer and allow an analysis of the use of the website. Google AdSense also uses so-called web beacons (invisible graphics). Through these web beacons, information such as visitor traffic on these pages can be evaluated. The information generated by cookies and web beacons about the use of this website (including your IP address) and delivery of advertising formats are transferred to a Google server in the USA and stored there. This information may be passed on by Google to contractual partners of Google. However, Google will not merge your IP address with other data stored by you. You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of this website. 17. Google Web Fonts 

The JobDone software services use so-called web fonts provided by Google for the uniform display of fonts. When you view a page, your browser loads the required web fonts into your browser cache to display text and fonts correctly. If your browser does not support web fonts, a default font from your computer is used.

18. Google Tag Manager 

Google Tag Manager is a solution with which we can manage so-called website tags via an interface and thus integrate e.g., Google Analytics and other Google marketing services into our online offer. 19. Hotjar Analytics & Feedback 

The JobDone software services use Hotjar’s service to improve the user experience. Hotjar Ltd is a European company based in Malta (Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe) Mouse clicks and mouse and scroll movements can be recorded. Keystrokes made on this website can also be recorded. Personalised information is not recorded. Hotjar uses a tracking code to collect and transmit your data. When you visit our website, the Hotjar tracking code automatically collects data based on your activity and stores it on the Hotjar servers (located in Ireland). In addition, the cookies placed on your computer or terminal device by the website also collect data. The JobDone software services use Qiscus Solutions as a chat software development kit, provided by Qiscus. Qiscus is a Company based in Singapore ( Qiscus Pte Ltd , 1 Coleman Street, #10-06 The Adelphi, Singapore, 179803), herein after referred to as “Qiscus”. 
Qiscus is used to run chat systems within our software services. Qiscus allows us to send media such as text, images, and videos within the app. Your personal information is exclusively within the control of JobDone or the individual End Users, as applicable. In addition, your metric data will also be measured by Qiscus and processed for chat purposes. Within the framework of the performance of contracts, we appoint payment service providers based on the Swiss Data Protection Ordinance and, where necessary, Art. 6 para. 1 lit. b. EU-DSGVO. Furthermore, we use external payment service providers based on our legitimate interests in accordance with the Swiss Data Protection Ordinance and, where necessary, Art. 6 para. 1 lit. f. EU-DSGVO to offer our users effective and secure payment options. 

The data processed by the payment service providers include inventory data, such as name and address, bank data, such as account or credit card numbers, passwords, TANs and checksums, as well as contract, sum and recipient related data. These details are required to carry out the transactions. However, the data entered is only processed by the payment service providers and stored by them. We as the operator do not receive any information about (bank) account or credit card, but only information to confirm (accept) or reject the payment. Under certain circumstances, the payment service providers may transfer the data to credit agencies. The purpose of this transmission is to check identity and creditworthiness. In this regard we refer to the general terms and conditions and data protection information of the payment service providers. 

The terms and conditions and data protection information of the respective payment service providers, which can be accessed within the respective website or transaction applications, apply to the payment transactions. We also refer to these for further information and the assertion of revocation, information and other rights affected. 

22. Newsletter – Mailchimp 

The newsletters are sent via the mailing service provider ‘MailChimp’, a newsletter mailing platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. You can view the data protection regulations of the mailing service provider here. The Rocket Science Group LLC d/b/a MailChimp is certified under the EU-US and Swiss-US Privacy Shield Agreement and thus offers a guarantee to comply with the European data protection level (PrivacyShield). The mail order service provider is used on the basis of our legitimate interests according to art. 6 para. 1 lit. f DSGVO and a contract for order processing according to art. 28 para. 3 p. 1 DSGVO. 

The dispatch service provider may use the data of the recipients in pseudonymous form, i.e. without allocation to a user, to optimise or improve its own services, e.g. for technical optimisation of dispatch and presentation of the newsletter or for statistical purposes. However, the dispatch service provider does not use the data of our newsletter recipients to write to them itself or to pass the data on to third parties. 

23. Google YouTube 

The JobDone software services use plugins from the Google operated YouTube site. The site is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA When you visit one of our sites equipped with a YouTube plugin, a connection is established to the YouTube servers. This tells the YouTube server which of our pages you have visited. 

If you are logged in to your YouTube account, you allow YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

24. Contractual services 

We process the data of our contractual partners and interested parties as well as other principals, customers, clients, or contractual partners (uniformly referred to as “contractual partners”) in accordance with the data protection regulations of the Federal Republic of Germany (Data Protection Act, DSG) and the EU-DSGVO in accordance with Art. 6 para. 1 lit. b. DSGVO in order to provide you with our contractual or pre-contractual services. The data processed in this context, the type, scope, purpose and necessity of their processing, are determined by the underlying contractual relationship. 

The processed data includes the master data of our contractual partners (e.g. names and addresses), contact data (e.g. e-mail addresses and telephone numbers) as well as contract data (e.g. services used, contract contents, contractual communication, names of contact persons) and payment data (e.g. payment history). 

As a matter of principle, we do not process special categories of personal data, unless they are part of a commissioned or contractual processing. 

We process data that are necessary for the justification and fulfilment of contractual services and point out the necessity of their disclosure if this is not evident to the contractual partners. Disclosure to external persons or companies will only be made if it is necessary within the framework of a contract. When processing the data provided to us within the framework of an order, we act in accordance with the instructions of the client and the legal requirements. 

When using our online services, we may store the IP address and the time of the respective user action. The storage is based on our legitimate interests, as well as the interests of the users in protection against misuse and other unauthorized use. This data will not be passed on to third parties unless it is necessary to pursue our claims in accordance with Art. 6 Para. 1 lit. f. DSGVO or there is a legal obligation to do so in accordance with Art. 6 Para. 1 lit. c. DSGVO. 

The data is deleted when the data is no longer necessary for the fulfilment of contractual or statutory duties of care or for dealing with any warranty or comparable duties, whereby the necessity of storing the data is checked at irregular intervals. In all other respects, the statutory storage obligations apply. 

25. Examination of creditworthiness and Scoring 

Insofar as we offer you the basic option of payment by invoice within the scope of our range of goods or services and you make use of this option, we reserve the right to obtain a credit report from a credit agency (such as Creditreform, Schufa, Bürgel or Infoscore) on the basis of mathematical-statistical methods. For this purpose, we will forward your data to the credit agency, as far as they are relevant to the contract, e.g. your name and address. We use the subsequent information about the statistical probability of a payment default to decide whether we offer you payment by invoice. 

The legal basis for this processing is our legitimate interest in the reliability of the claim in accordance with Art. 6 Para. 1 letter f) DSGVO. 

26. Online job applications / publication of job advertisements 

If required, we offer you the opportunity to apply for a job with us via our website. With these digital applications, your applicant and application data will be collected and processed electronically by us for the purpose of handling the application procedure. 

The legal basis for this processing is § 26 para. 1 p. 1 BDSG in conjunction with Art. 88 para. 1 DSGVO. 

If a contract of employment is concluded after the application procedure, we will store the data you provide during the application process in your personnel file for the purpose of the usual organisational and administrative process – this is, of course, in compliance with the more extensive legal obligations. 

The legal basis for this processing is also § 26 para. 1 sentence 1 BDSG in conjunction with Art. 88 para. 1 DSGVO. 

If an application is rejected, we automatically delete the data transmitted to us two months after notification of the rejection. However, the data will not be deleted if the data requires longer storage of up to six months or until the conclusion of legal proceedings due to legal provisions, e.g. due to the obligation to provide evidence under the German AGG. 

The legal basis in this case is Art. 6 para. 1 lit. f) DSGVO and Art. 24 para. 1 no. 2 BDSG. Our legitimate interest lies in legal defence or enforcement. 

If you expressly consent to a longer storage of your data, e.g. for your inclusion in a database of applicants or interested parties, the data will be processed further on the basis of your consent. The legal basis is then Art. 6 para. 1 lit. a) DSGVO. However, you can of course revoke your consent at any time in accordance with Art. 7 Para. 3 DSGVO by making a declaration to us with effect for the future. 

27. Linking Social-Media via graphic or text link 

On our software services we also advertise presences on the social networks listed below. The integration takes place via a linked graphic of the respective network. The use of this linked graphic prevents that when a website with a social media application is called up, a connection is automatically established to the respective server of the social network to display a graphic of the respective network itself. Only by clicking on the corresponding graphic is the user forwarded to the service of the respective social network. 

After the user is forwarded, information about the user is collected by the respective network. It cannot be excluded that the data collected in this way is processed in the USA. 

This is initially data such as IP address, date, time and visited page. If the user is logged into his user account of the respective network during this time, the network operator may be able to assign the collected information of the user’s specific visit to the user’s personal account. If the user interacts via a “share” button of the respective network, this information can be stored in the user’s personal user account and published if necessary. If the user wants to prevent the collected information from being directly assigned to his user account, he must log out before clicking on the graphic. It is also possible to configure the respective user account accordingly.

JobDone uses Hubspot, a service of the American Hubspot Inc. for analysis and communication purposes. Hubspot uses web beacons and cookies to help JobDone analyze your use of the software services.  In other words, when you contact us, request a quote, register for an event or send another form integrated from Hubspot, your activities on the software services will be associated with your cookie if you have given your consent in accordance with Art. 6 para. 1 lit. 1 of the Swiss Federal Data Protection Act and thus allow an in-depth analysis of your use of the software services (e.g. pages visited, date and time of access, forms completed, documents downloaded).  In this way JobDone can better tailor the user experience with the software services and external communication to the needs of the visitors. 29. Amazon Web Services (AWS) 

The JobDone software services use Amazon Web Services Inc. 410 Terry Avenue North, Seattle WA 98109, USA (hereafter: AWS) to ensure the full functionality and availability of our software services. In this context, personal data may be transferred to AWS. The legal basis for data processing is Art. 6 Par. 1 lit. f GDPR. The use of AWS enables a basic functioning of the software services. Amazon AWS is certified under the EU-US and Swiss-US Privacy Shield Agreement (https://www.privacyshield.gov/participant?id=a2zt0000000TOWQAA4&status=Active). 32. Note concerning data transmission to the USA (United States of America) 

For the sake of completeness, we would like to point out that users based in Switzerland are subject to surveillance measures by US authorities, which generally allow the storage of all personal data from Switzerland – which has been transferred to the USA. 

This is done without any differentiation, restriction or exception based on the objectives pursued and without any objective criterion that would make it possible to limit the access to the data by the US authorities and their subsequent use to very specific, strictly limited purposes that could justify the access to these data as well as the interference associated with their use. Furthermore, we would like to point out that there are no legal remedies available in the USA for Swiss data subjects that would allow them to obtain access to the data concerning them and to have them corrected or deleted, or that there is no effective legal protection against general access rights of US authorities. We explicitly draw the attention of the person concerned to this legal and factual situation in order to make an appropriately informed decision to consent to the use of their data. 

We would like to point out to users residing in an EU member state that the USA does not have an adequate level of data protection from the perspective of the European Union.

The copyrights and all other rights to content, images, photos or other files on the JobDone software services, belong exclusively to JobDone AG or the specifically named rights holders. For the reproduction of all files, the written permission of the copyright holder must be obtained in advance. 

Anyone committing a copyright infringement without the consent of the respective copyright holder may be liable to prosecution and damages. 

34. General exclusion of liability 

All details of our software service offer have been carefully checked. We make every effort to ensure that the information we offer is up-to-date, correct and complete. Nevertheless, the occurrence of errors cannot be completely ruled out, which means that we cannot guarantee the completeness, correctness and topicality of information, including journalistic and editorial information. Liability claims arising from material or non-material damage caused by the use of the information provided are excluded, unless there is evidence of wilful intent or gross negligence. 

JobDone may change or delete texts at its own discretion and without notice and is not obliged to update the content of the software services. JobDone also accepts no responsibility or liability for the content and availability of third party websites that can be accessed via external links on this website. For the content of the linked sites the operators of these sites are exclusively responsible. The publisher thus expressly distances itself from all third-party content that may be relevant under criminal or liability law or that is contrary to public decency. 

35. Changes 

We reserve the right to amend this privacy policy at any time and without prior notice. This in order to comply with changed legal situations or changes in services, in particular data processing. The current version published on our website applies. Insofar as the data protection declaration is part of an agreement with you, we will inform you of the change by e-mail or other suitable means in the event of an update and, if necessary, obtain your consent. 

36. Right of objection 

If your personal data are processed by us on the basis of legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO, you have the right to object to the processing of your personal data in accordance with Art. 21 DSGVO, insofar as this is done for reasons arising from your particular situation. Insofar as the objection is directed against the processing of personal data for the purpose of direct marketing, you have a general right of objection without the need to indicate a special situation. If you wish to exercise your right of withdrawal or objection, it is sufficient to send an e-mail to us or contact directly the person responsible for data protection in our organisation listed at the beginning of this privacy policy. 

37. Applicable law and place of jurisdiction 

This Data Processing Agreement shall be governed by and construed in accordance with Swiss law. 

All disputes arising out of this Data Processing Agreement, including any dispute regarding the existence or validity of this Data Processing Agreement, shall be brought exclusively before a court in Basle.
